About these terms
These Terms & Conditions apply to all photography, videography and reel services provided by [Legal business name] operating as Blue Wings Studio (“we”, “us”), based in [City], [Province], Canada. By booking our services or paying a retainer, you (“the client”) agree to these terms and to your individual service agreement. Your signed service agreement takes priority if anything differs.
Bookings & retainer
- Your date is reserved only once the service agreement is signed and a non-refundable retainer of [X]% of the total fee is received.
- Until both are received, the date remains available to other clients.
- Package details, hours of coverage and deliverables are confirmed in your service agreement.
Payments
- All prices are in Canadian dollars (CAD) and exclude applicable taxes (GST/HST/PST), which are added to your invoice.
- The remaining balance is due [X] days before the event date. For corporate clients, invoices are payable within [X] days unless agreed otherwise.
- We accept [e-Transfer, credit card, bank transfer]. Late payments may incur a fee of [X]% per month.
- Final galleries and films are released once the account is paid in full.
Cancellations & changes
- If you cancel, the retainer is non-refundable. Cancellations within [X] days of the event are charged [X]% of the total fee.
- You may reschedule once, at no extra cost, to a new date within [12 months], subject to our availability. The retainer is transferred to the new date.
- If we cannot attend due to illness or emergency, we will arrange a qualified replacement photographer or videographer. If that is not possible, all payments made will be refunded in full.
- Changes to coverage hours or deliverables can be requested in writing and may change the fee.
On the day
- Coverage runs to the agreed schedule. Extra time on the day is charged at [$X CAD] per hour, per team member.
- For events longer than [6] hours, we ask that a meal and short break be provided for each team member.
- We are not responsible for shots missed because of venue or officiant restrictions, schedule delays, weather, lighting conditions or guests blocking the view.
- Please share a key contact person and a list of must-have family groups at least [7] days before the event.
Travel
Travel within [X km] of [City] is included. Beyond that, mileage is charged at [$X CAD] per km. For destination events, flights, accommodation and ground transport are quoted separately and agreed in advance.
Editing & delivery
- Sneak peek: within [X] days. Full photo gallery: within [X] weeks. Highlight film: within [X] weeks. Reels: within [X] days when included.
- All images and films are edited in Blue Wings Studio’s signature style. Raw, unedited files are not supplied.
- Photos and films are delivered through a private online gallery and download link.
- Re-edits beyond [one] round of revisions on films may be charged at our hourly editing rate.
Copyright & usage
- Under Canadian copyright law, Blue Wings Studio owns the copyright in all images and footage we create.
- Private clients receive a personal-use licence to download, print and share their images and films (credit to Blue Wings Studio appreciated). Selling, editing, filtering or entering them into competitions is not permitted without written consent.
- Corporate and artist clients receive the commercial licence set out in their agreement.
- We may use selected images and clips in our portfolio, website and social media. If you prefer we don’t, let us know in writing before the event.
Music in films
We use properly licensed music in all films. Commercial or copyrighted songs you request may not be licensable, and online platforms may mute or block films that use them. We will suggest suitable licensed alternatives.
Gallery storage
Online galleries stay available for [X months] after delivery. We keep backup copies for [X year(s)], but cannot guarantee storage after that. Please download and back up your files promptly.
Liability
We take great care of your files and use professional, backed-up equipment. In the rare event of equipment failure, file loss or damage beyond our control, our total liability is limited to the amount you have paid for the affected service.
Events beyond our control
Neither party is responsible for failing to perform because of events beyond reasonable control, such as severe weather, natural disasters, public-health orders, government restrictions or serious illness. In such cases we will work with you to reschedule first, before discussing any refund.
Governing law
These terms are governed by the laws of the Province of [Province] and the federal laws of Canada that apply there.
